New laws, regulations and standards such as SEC Rules 17a-3 and 17a-4,
Sarbanes-Oxley, DOD 5015.2, HIPPA and OSHA are a few examples from financial
services, corporate governance, Government, healthcare and human resources that
have caused a sea change in the way records are managed.
Courts, attorneys and special interest groups have discovered that records are even more important than witnesses in determining “what did they know and when did they know it”. Records can help to prove innocence or lack of intent. In order to use them, it is important to make sure that the control, storage and use of the record occurs in the normal course of business and to demonstrate that the records accurately reflected a particular state in time. Records can also prove to be a liability and poor record keeping can have serious consequences.
